III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the ~nspectron <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation. Mining. and Safety (Division). A final bond release application is currently <br />under review for this site for all areas except 1.2 acres at the NW-1 ventilation shaft area <br />Ground conditions were snow-covered in all areas and the weather was sunny and cold <br />Hydrologic Balance <br />Ground water wells SF-1 and SF-2 were visited in Cherry Canyon to the east of the mine <br />site. Coal bed methane development has changed the surrounding area due to road <br />construction. These wells will require final abandonment and reclamation prior to any final <br />decision on the pending bond release application. <br />Development Waste <br />Gas pipeline activities have impacted the toe of the development waste pile on the east side. <br />Current construction has exposed the development waste while the pipeline ~s being buried. <br />It rs not clear at this time how this area will be reclaimed. The Division recommends that <br />Basin discuss this with the gas operator to ensure the long-term stability of the waste pde <br /> <br />G'r '.`~ :.
