III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection, Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. $ill Bear represented <br />the operator during the inspection. Also on the inspection was Jim Stover, the consultant for the mine. <br />There had been a recent snowfall and much of the mine site was covered in snow. <br />Main Mine Site <br />Although the longwall is in operation, there was very little stockpiled coal on the coal stockpile bench <br />and on the D-seam portal bench. There was no sign of fugitive dust going offsite. The protective bean <br />on the outside edge of the coal stockpile bench was functional. <br />The paved main haul road was in good condition. The guardrail was in place. The mine ID sign was up <br />at the entrance to the mine. There were no signs of slope instability along the haul road except for one <br />small slump near the top of the hill just before the D-seam bench. <br />No problems were noted with any of the facilities on the D-seam portal bench. The highwall and cut <br />slopes behind the office and warehouse appeared to be stable. The wash plant was in operation. There <br />is a remnant of the small slump in the cut slope behind the wash plant. This remnant will be watched to <br />see if it is stable or not. <br />There was just a little ice-covered water in Pond B. The pond embankment was snow covered but <br />appeared to be stable. The primary discharge pipe was attached to its float and the emergency spillway <br />had sufficient capacity. <br />Gob Pile No. 2 <br />The haul road to the two gob piles was dry and in good condition. The outside road berm was in place, <br />as were the road ditches. The operator was placing and compacting coal refuse onto the top of the pile. <br />The material being placed was not wet. The top of the pile had positive drainage. The pile outslopes <br />were covered in snow but did not show any signs of slope instability or erosional gullying. <br />Ponds C and D had low levels of ice-covered water in them. There was only a little ice-covered water <br />in Pond F, well below discharge levels. The pond spillways were functional and the pond <br />embankments appeared to be stable. <br />Unit Train Loadout <br />A fully loaded unit train was on site. Although snow covered the ground, there were no signs of <br />fugitive dust near the loading facilities and along the conveyor corridor leading to the ]oadout. The <br />mine ID sign was up at the south entrance. Pond J had no standing water or ice in it, just snow. Pond K <br />had a little ice-covered water in it.
