(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1995-097 <br />INSPECTION DATE 7-18-2003 <br />INSPECTOR'S INITIALS SSS <br />This was a brief partial inspection conducted at the operator s request to verify corrective actions taken for problems noted in <br />previous inspection reports. <br />Noxious and/or problematic weeds appeared to have been treated with herbicide as reported. A weed control plan drafted by <br />Jim Lewis -Pitkin County Vegetation Management is now in place. <br />The approved mine plan contains commitments to regrade the main bench so that it drains toward the large depression near <br />the entrance; regrade the top of the No. 2 portal dump to drain into the mountain; fence the site and pertorm some reseeding <br />within 3 years of permit issuance in January 1997. This inspection verified that these tasks have taken place as required. A <br />major portion of the main bench is occupied by fill that was brought into the site and disposed of under agreement with other <br />government agencies. The operator has clarified that this importation and permanent disposal of material was conducted prior <br />to issuance of the DMG permit, though this information was not specified in the permit. <br />All of the barrels, 5 gallon cans, and fuel tanks on the main bench area that contain hazardous materials such as waste oil, <br />gasoline, hydraulic fluid, diesel fuel, antifreeze, etc. that were not stored properly, within approved spill containmentstructures, <br />as noted in the previous inspection report, have either been removed from site or are now stored within adequate spill <br />containment. Anew spill containment structure is being constructed to hold a diesel fuel tank on the top of the fill area located <br />on the main mine bench. A technical revision to the permit6 should be filed to address construction specifications and <br />reclamation plans and costs for this structure. The technical revision will also need to include wording that is specified in the <br />memo enclosed in the 10-29-2002 inspection report, regarding DMG notification requirements for spills of toxic or hazardous <br />materials at mine sites. <br />A significant amount ofjunk has been removed from the site, though much still remains to be removed. The operator indicated <br />that clean-up efforts would continue. <br />During this inspection, it was verified that portal closures on the No. 2 and the Clark adits were adequate. Therefore, costs for <br />construction of these closures can be removed from the reclamation cost estimate for this site through a release request <br />process. It was also verified that the shaft enclosure is . Therefore, costs for construction of these closures can be removed <br />from the Reclamation cost estimate for this site. It was also verified that the shaft enclosure is not adequate secure the shaft. <br />The operator indicated that the main level pit is a feature that EPA has required to be permanent for minimizing off-site <br />discharges by containing flows from a 100 year event. Because this pit cannot be utilized as an on-site disposal area forjunk <br />and material from facilities demolition, the reclamation cost estimate will need to be revised to include additional haul and <br />disposal costs, or for excavation of a burial pit, for this material.
