<br /> <br />MINE ID # OR PROSPECTING ID #M-77-3~ <br />INSPECTION DATE 10-22-99 <br />(Page 2) <br /> <br />INSPECTOR'S INITIALS BK <br />The Division conducted a monitoring inspection of the site on 10-22-99. The site is <br />a 110(2) clay mine located approx.32 miles South of Pueblo, Colorado. According to the annual <br />report and what was observed on site, the only mining activity taking place is in previously <br />disturbed areas. In 1996, the operator submitted and later withdrew a TR request to remove <br />approximately 3.7 acres from the permit area that was reclaimed and add 3.6 acres. During <br />that years inspection, it was noted that the permit boundary markers as noted on site and as <br />approved did not conform to the approved plan. However, in December 1996, the operator <br />withdrew the request and agreed to place permit boundary markers to reflect what was approved <br />in the permit application. Permit boundary markers were properly posted. Reclaimed areas <br />appeared stable and sparsely vegetated. No major erosional features were noted. The high wall <br />in the permit area was stable. A small quantity of large sand stone slabs and over burden <br />material was noted in the main PIT floor area. According to Mr. Welte, due to the thin layer <br />of clay, there probably are no plans to mine the area. If this is the case, the Division's <br />representative suggested that the operator can either apply for a temporary cessation status <br />or commence reclamation. Mr. Welte stated that he will talk to Mr. Joe Welte and let the <br />Division know as soon as possible. Since there is still some mining taking place at present, <br />the operation is in compliance with the approved permit. A small amount of top soil was <br />noted stockpiled along the Eastern portion of the permit area. It was stable and no major <br />problem noted. The financial warranty for the site was calculated in 1994 based on existing <br />mining plan and was raised to $36,000.00.
