III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on June 21, 2007 by Mike Boulay of <br />the DRMS. Henry Austin from the Office of Surface Mining conducted a special focus oversight <br />inspection on recently re-graded lands for the past evaluation year. Roy Kazo from Seneca Coal <br />Company was present during the entire inspection. Weather conditions were partly cloudy and <br />cool. Ground conditions were dry at the site. <br />As part of this inspection we evaluated compliance with approved post-mining topography and <br />potential for off-site impacts with regard to sediment and surface water runoff control within the <br />recent re-graded lands. We began the inspection by reviewing pertinent documentation from the <br />permit application package including pre and post-mine cross-section maps (Exhibit 20-2A), <br />Operations Plan (Exhibit 12-1), Backfill & Grading Plan (Exhibit 19-1A), and Post-Mining <br />Topography Map (Exhibit 20-2). These maps were brought with us for use in the field during the <br />inspection. <br />Backfill & Gradine <br />Recently re-graded lands are located in the Yoast South Area and include the Wolf Creek Pit, <br />Scraper Pit and South Valora Pit as shown on Exhibit 19-1A. Backfill and grading operations <br />were completed in Yoast South over the last two years. Final grading to the approximate original <br />contour was completed in the spring, 2006 at the Wolf Creek Pit, Scraper Pit, and South Valora <br />Pit. The entire Yoast South Area was viewed from a good vantage point located adjacent to <br />Topsoil Pile L. As seen in attached Photographs Numbers 1, 2, and 3, recently re-graded lands <br />blend in well with the surrounding undisturbed landscape. The present surface configuration <br />achieved by Backfill and grading of the mined areas closely resembles the general surface <br />configuration of the land prior to mining. SCC is in compliance with the backfilling and grading <br />plan and reestablishment ofthe approximate original contours approved in the reclamation plan. <br />All Backfill and grading is complete at the Yoast Mine with exception of the slide area above <br />Pond 012. <br />Topsoil and Reve etg ation <br />Topsoil was redistributed during the summer, 2006 at all of the final graded locations. Some <br />topsoil remains at Topsoil Pile L which will be used for the final reclamation of the Pond 012 <br />slide area. <br />
