Rawever, If Mineral County takes over the CDOT pit sad <br />converts the two epee to a 112 operatlou, these three undisturbed areas could be absorbed Into the proposed permit area by swapping their total <br />area for equal undlemrbed acreage Inside the 112 permit boundary. Thle swap could be completed ae part of the 112 converelou apptlcatlan and <br />would not require the Mineral County to go through the usual procedures for release of reclamatlou reepans161tlty for these three smatl uudleturbed <br />areas. <br />As part of the I12 converelon process, Mineral County wID used to obtain a signed, notarized letter from the Colorado Division of ®ghways statlng <br />that they agree ro reDnquieh their right to Permit No. M~81~I50 upon approval of a 112 couverelou apptlcatlon, submitted by Mineral County, which <br />incorparntea the permitted area of Permit No. M~1~I50 Into the ll2 permit area. <br />Permit No. M~1~I50 wID then be termluated ae part of the 112 converelan approval tar Permit No. M-84-097. (Aa app0catloa for coaverelon of a 110(2) <br />operetlon to a 112 aperetlon le enclosed with this report. The copy of the Minerals Rules and Regulatlone requested by Mineral County w1R be mailed <br />Tram the Deaver OM6 ofDce.) <br />Minaret County bas baea Importlng material, from local road cut operatlona, to the site for use se topaoll during reclamatlon. This process was <br />conducted In response to m Inepectlon conducted in 1994 where the inspector soled that there was uo topaoll stockpile au site though the permit <br />ludlcated that 9-0 Inches would be replaced at reclamatlan. Mineral County should be aware that all material from road cuts may not be suitable <br />88 growth medium far revegetatlon and may, In fact, hinder the reclamatlan effort If the material Is Infertlle or has poor Boll structure. Soil that <br />Is Imported to the site should be veriDed se good growth medium by teatlug or by ensuring that oWy topaoll Is Imported for reclamatlon.
