III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection of the New Horizon Mine for the month of February. 2003. The purpose of <br />this inspection is to conduct a normal operations and environmental compliance inspection. The weather <br />was cloudy and cool. <br />AVAILABILITY OF RECORDS: Records were inspected and found to be in compliance. See page 6 of <br />this report for further details. <br />ROADS: Haul roads and the BB road detour were inspected and no problems were noted. A county <br />roads representative met with mine personnel to discuss minor road repairs that needed attention. <br />HYDROLOGIC BALANCE: Mine 2: Pond 8 had water in it but was not discharging. All ditches and <br />culverts were clear and capable of functioning as designed. Pond 7 had water in it but was not <br />discharging. Pond 9 was dry. <br />BACKFILL & GRADING: B & G was in progress as is normal. No problems were noted. The land <br />continues to be reclaimed to the approved post mining topography map and no low spots were noted. <br />EXPLOSIVES: Records were inspected and found to be in compliance. All blasting procedures are being <br />followed and seismograph's readings are available for all but parting shot blasts. <br />TOPSOIL: Topsoiling is being accomplished with truck and shovel as time permits and is being stockpiled <br />for later distribution. <br />GENERAL MINE COMPLIANCE: The mine continues to exert an outstanding effort to comply with all <br />rules and regulations of the Colorado DMG. An area that required more fill during the recent Phase 1 <br />bond release has been repaired and at the landowners request, a stock pond has been removed and the <br />land regarded for alfalfa production. See the photos below. <br />RECLAMATION SUCCESS: Although the area has sustained a severe drought, due to a sound irrigation <br />program, the site has wintered well. The only problem noted was at Mine 1, the "Rice Tract" which has <br />yet to recuperate from overgrazing. It is for this reason that the Division is not allowing any grazing on the <br />property until final bond release is achieved at this location. <br />
