III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Ice Dudash of the Colorado Division ofReciamation, Mining and <br />Safety. No one represented the operator during the field inspection. The entire mine site was covered in about 6 <br />to 8 inches of snow. <br />Roads <br />The paved entrance road was snow covered but was passable. The bridge also was passable. <br />Facilities <br />The entrance gate was closed and locked. The "no trespassing" sign was up on the gate. <br />The condition of the mine office was basically the same since the last inspection in November, although the <br />sliding glass door was shattered, perhaps from vandalism. <br />Hydroloay <br />There was a little snowmelt in the sediment pond, although the rest of the pond and pond embankment were <br />snow covered. The gated primary discharge valve was in the closed position. The collection ditch leading into <br />the sediment pond had sufficient capacity. <br />The water in the spring water treatment pond was ice covered. The ice level in the pond was just a few inches <br />below the horizontal pipe. Thera was a discharge from the pond in the amount of about 20 gallons per minute. <br />The color of the discharge was orange which has been the case since the beginning of the spring. This orange <br />colored discharge has been shown to be in compliance. <br />The east spring was flowing from the hillside and was contained in the constructed channel and culvert. Water <br />vapor was observed as the spring water came out of the hillside. <br />Reclamation <br />The reclaimed portal road and backfilled portals were covered in snow. Above the west portal reclaimed bench <br />but below the overlying cliff, there were two small areas that were wet from snow melt.
