III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection consisting of review of aerial photos by Janet Binns of CDMG. Aerial <br />photos were taken by Harry Ranney of CDMG on August 29, 2005. Mine site appears dry. Trapper <br />mine is an active surface mine. <br />Roads: D pit haul road remains in good condition. LOM Haul road appears to be in good condition. <br />Hvdrologic Balance: Johnson ponds are holding full pools of water. East Flume, East Middle Flume, <br />Middle Flume 1 and 3 Ponds all aze holding considerable pools of water. East Flume and Middle <br />Flume No. 3 are not discharging as water level is visibly below the discharge point. Water is noted in <br />stock ponds in the vicinity of D-Pit. <br />Backfill and Grading: F-pit explosives storage area is in the process of being graded out, Some <br />gullying has occurred in the Spoil material north of the former F-pit explosives area. This area has not <br />received topsoil yet and is still actively worked. <br />The ash pit continues to receive coal ash waste. Capping and grading of the north end of the ash pile <br />continues as well. No recent backfilling & grading, or ash disposal was apparent at the D pit. <br />General Mine Plan: F-pit has progressed to the south through the ridgeline. West Horse pond is in <br />place in the southern drainage basin. <br />Slides & Damage: A portion of the southern highwall appears to have slid or been cast blast into the <br />southern portion of the pit. This pit had been approved for ash disposal but remains inactive at this <br />time. Gullying at the south and west sides of Pit D indicates that TMI needs to assure that runoff is <br />routed to adequate ditches prior to snow cover and future runoff events. <br />Topsoil: Topsoil laydown is being conducted west of Pit F. Topsoil replacement appears incomplete <br />at the SE portion of the F-AB-OS parcel and appeazs to be ongoing. <br />Reclamation success: Reclaimed areas visible in the aerial photos appear to be in good condition <br />without signs of gullying or lazge bare areas. <br />No concerns were visible from these aerial photos. The mine site appears to be maintained. <br />
