III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection, flown on ivlay 18, 1999. The digital pictures were reviewed on Iviay 28, <br />1999, by Joe Dudash of the Colorado Division of lvlinerals and Geology. No compliance problems <br />were observed during the overflight. The pictures showed that there had been some recent <br />precipitation at the mine site. <br />Facilities <br />There were at least 25 coal rail cars on site, some already filled and some waiting for loading. There <br />were no problems with fugitive dust. The operator is not having a problem getting rail cazs. There were <br />no signs of coal going offsite. The facilities bench berm appeazed to be working. Only under the <br />conveyor was there evidence of coal on the bench outslope. Runoff from this area goes through silt <br />fence and straw bales. No problems were noted with any of the facilities. <br />Hydrology <br />The main pond water level was up to the grass line, which is above the primary' tube level. No <br />evidence of discharge was observed. <br />No problems with ditches were observed. <br />Roads <br />All of the roads were nearly dry and passable. <br />c:\ms97\ten•orlinsp5996 <br />
