L_J <br />MINE ID aY OR PROSPECTING ID ak M-1978-305 <br />INSPECTION DATE 1/23/01 <br />INSPECTOR'S INITIALS RCO <br />the 1 .25 acres is not to be disturbed, by mining, stockpiling, placing equipment there or by other uses, unless a revision <br />is applied for, allowing that change. <br />The operator is reminded that the State must account for all aspects of reclamation, and include in the bond all costs for <br />adequately completing it. The State does not dictate to the operator what the mining and reclamation plan details are. <br />A bond amount is based on the details of the plan that the operator submits and which are approved by the Division, and <br />may be influenced by reclamation that the operator performs, or by disturbance carried out as part of his operations. A <br />bond increase is not a penalty or an order to shut down and commence final reclamation, but simply reflects the costs of <br />what a contractor who is awarded a reclamation contract would charge the State. <br />This office will recalculate the bond amount estimate, based on onsite observations, discussions, and the operator's written <br />submittals. This office will send the revised figures to the operator for review. The operator is reminded that: 11 the site <br />is underbonded even without this conversion expansion, 21 all operators can reclaim their disturbance for less money than <br />what the State is charged by contractors, 31 material amounts can be revised but equipment unit costs and labor rates <br />cannot, 41 that there is a 60-day window during which discussions about the bond may occur, but at the end of which bond <br />increases must be submitted. Changes of reclamation plan details cannot be made without an approved technical revision <br />or amendment. <br />There were no problems noted at this time.
