<br />edge may be creating mining disturbance outside the present permit boundaries. If this is <br />the case, the Division has been instructed by the Mined Land Reclamation Board to bring all <br />such activities to the Board to be considered as a possible violation (only the Board may find <br />a violation of the law or permit). The Division is presently investigating this possibility (see <br />the inspection report). <br />3. Rubble and big boulders [cashed over the side. The Division shares this concem for the <br />same reasons as in #2 abovf~. <br />4. No reclamation has been done for at least eight years. The Division cannot require an <br />operator to reclaim lands within the permit boundaries if sufficient bond is posted, no off-site <br />damage is occurring as a result of leaving the lands disturbed and the permit allows these <br />lands to remain disturbed until mining is completed. We will, however, review the permit <br />and act accordingly. <br />5. The quarry size is over the present limit of 9.9 acres. The Division also shares this <br />concem (see the inspection report of November 11, 1998) and is investigating this aspect of <br />the mining operation, <br />6. Quarry owners need to bey kept in check. The Division can only regulate mining <br />operations to the extent that i:he Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, the accompanying Rules and Regulations and the permit allow. <br />Thank you for your interest in making sure that mine operators are operating in compliance <br />with the law, regulations and their permits.
