`J <br /> <br />IV. Problems, Recommendations and Compliance Dates <br />The operator is advised that the following problems have been identified <br />during inspections and that failure to correct the problems may result in the <br />Division taking an ENFORCEMENT ACTION pursuant to CRS 1973, as amended, <br />34-33-123. (Recommendations and compliance dates are to be clearly noted. <br />Dates are to be specific, e.g., January 31, 1983 and underlined.) <br />NOV C-84-081 was issued for several drainage problems noted at the Energy <br />No. 3 Mine and Fish Creek Tipple. The problems involving areas contained <br />within this permit application were: <br />1. The drainage ditch on the east side of the haul road north of the <br />Middle Creek Pit was cut to allow discharge to an undisturbed area. <br />2. A road at the tipple was directing drainage away from Collection <br />Ditch E1. <br />The deadline for correcting these problems -May 23, 1984. Both problems have <br />been corrected. <br />
