(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2000-016 <br />INSPECTION DATE 12/09/02 <br />INSPECTOR'S INITIALS ESC <br />This was an inspection of the Riverbend Operation conducted by Erica Crosby of the <br />Division of Minerals and Geology. Duane Bollig of Lafarge West, Inc. was present during <br />the inspection. <br />The purpose of the inspection was to determine if mining or reclamation was taking place <br />at the site. A mining and reclamation permit has not been issued for the site because the <br />applicant did not post the performance and financial warranty within one year of Division <br />approval. <br />No mining or reclamation was taking place on site. One new oil well structure was noted <br />on the north east side of the permit area. This structure appears to be within 200 feet <br />of the affected land. <br />Rule 4.1(2) of the Construction Materials Rules and Regulations states, <br />"No permit may be issued pursuant to the Act until the Board or Office receives and <br />approves the Performance andlor Financial Warranties required herein. If these <br />Warranties are not received within one calendar year of approval of an application <br />for any new permit, amendment or conversion, the Board shall hold a hearing to <br />reconsider the previous approval," <br />In addition, in 1991 the Mined Land Reclamation Board instructed the Division that all <br />operators who had not posted bond within one year of application approval would be <br />required to republish and renotify surrounding landowners and owners of structures within <br />200 feet of the affected land and undergo a new term of public comment regarding the <br />application. The Division has no evidence that the operator has done this. <br />The Division scheduled this matter for reconsideration of the Division's decision of <br />approval before the Mined Land Reclamation Board at the December 11, 2002 hearing.
