(Page 2) <br />MINE ID 1 OR PROSPECTING ID 1 !F7l-516 <br />INSPECTION DATE 02-21-95 INSPECTOR'S INIT141S SSS <br />OBSERVATIONS <br />This was a crnwlete inspection of the Horvath No. 1 Pit located approzimately one Bile southeast of Breen, Colorado in La Plata County. Ground conditions <br />were generally drr with a small accumulation of water in the bottom of the pit fro snowmelt. The operation is permitted to disturb 9.8 acres but has <br />only disturbed approximately 2 to 3 acres to date. The operator indicated that the last activity in the pit was in late 1990 for graveling some roads <br />on the ranch of the previous operator who was the permittee at that time. This activity was not reported in the annual report for that year. <br />The mine has been inactive since that time. However, to date the Division has not. received a Notice of Temporary Cessation (TC) as required by Rule 1.13.5 <br />for env mine which has been in anon-producing status for 180 days or more. io resolve this problem the operator must. execute one of the following <br />options: (a) initiate final reclamation of the site; <br />Ib) file a notice of TC as provided for in Rule 1.13.512); <br />Ic) suMit a request for a Technical Revision to the <br />permit tm allow intermittent minims activities as <br />provided for under Rule 1.13.1; <br />(d) re-activate the operation. <br />The depth of the pit is approzimately 20 feet and is permitted to allow mining to 30 feet. This depth of pit, which is basically an incised pit, is not. <br />conducive to the approved past mining land use of irrigated pasture. The current operator/permittee/landowner has expressed an interest in revising the <br />post mining land use to pasture with a change of final slope grade to a more realistic grade than the approved 10:1 slopes. These revisions, plus any <br />proposed revisions to the revegetation specifications will need to be incorporated into the permit through the Technical Revision process. <br />Please be aware, Rule 3.1.12 of the Mineral Rules and Regulations requires the operator to post a sign at Ne entrance of the mine site which is clearly <br />visible from the access road and specifies the following: (al The name of the operator, <br />(h) An indication that a reclamation permit for the operation <br />has been issued by the Colorado Mined Land Reclamation Board, <br />and <br />Ic) The Permit Number. <br />The sign was mat observed during the inspection and should be installed as indicated above. The affected area is well marked with fencing on all sides. <br />In 1967, the U.S. congress amended the Clean Hater Act to expressly include storm water discharges fro industrial sites as requiring Clean Hater Act <br />controls. In 1990, EPA issued regulations that require specific industrial activities to obtain permits in order to discharge store water fro their <br />facilities. Active and inactive mining operations where storm water comes into contact with overburden, raw material, intermediate products, byproducts, <br />finished products or waste products located at the mining site are specifically included. The deadline to apply for a storm water permit was October 1, <br />19rQ. If a storm water permit for this mine has not yet been obtained, the operator must make application for such a permit as soon as possible. If any <br />store water cmtrol structures are required to be constructed at the mine as a result of the storm water permitting process, a revision must then be <br />submitted to this Division to include the operational and reclamation aspects of such structures in the Reclamation Permit. <br />Changes to the Mined Land Reclamation Act, doe to the passage mf Senate Bi1191-177 in 1991, included the removal of the (5000.00 bond cap for 11012) type <br />permits. All nine sites in Colorado are now required to be banded for the actual cost of reclamation if, in the case of permit. revocation and bond <br />forfeiture, the state were to put the reclamation work out for competitive bid. Review and recalculation of the required land for reclamation of this <br />aeration will take place over the nett few months.
