<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />of the bench was replaced with a new 30" culvert earlier in the <br />summer. The culvert was clean and appears to have functioned well. <br />Lower on the road, the inlet sump for the 18" culvert above the <br />equipment storage area was completely filled with sediment, and the <br />culvert was partially blocked; maintenance required. The inlet <br />sump for the 12" culvert below the equipment storage area was <br />filled in and will need to be cleaned out, however the culvert <br />itself was clean. <br />Sediment pond highwater mark was visible just below the emergency <br />spillway. As indicated previously, the operator had discharged the <br />pond through .the primary spillway, and water level at the time of <br />inspection was below the primary spillway level. Water in the pond <br />was relatively clear. A sediment delta from the storm runoff was <br />present at the upper end of the pond. <br />The upland diversion ditch in the topsoil stockpile vicinity was <br />filled in with sediment by upland flows and repairs are necessary. <br />Stockpiled materials were not compromised, as most of the upland <br />flow apparently drained into the sediment pond rather than through _ <br />the stockpile area. The diversion berm in the vicinity of the <br />riprap stockpile was breached and will need to be repaired. <br />Sediment traps in the stockpile and office areas appear to havg <br />functioned effectively and apparently did not overtop. In genera3; <br />structures which were most impacted by the heavy storm flows and <br />for which maintenance was necessitated are cu_1_v_e_rts, ditcries and <br />berms which divert upland flows. <br />Suonort Facilities <br />The operator indicated that resumption of active mining was <br />anticipated at the mine within the next couple of months, and that <br />in association with resumption, certain modifications to surface <br />facilities and coal handling structures would be submitted as <br />technical or minor revisions in the. near future. Changes would <br />include dismantling and removal of the old crusher, portal <br />improvements, sediment pond relocation and coal storage expansion, <br />and installation of an overland conveyor from the portal area to <br />relocated coal stockpile area. <br /> <br />
