III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. The Grassy Gap mine is a reclaimed <br />surface mine. The mine permit and reclamation liability bond have been revoked by DMG. <br />Siens & Markers : DMG informational signs remains a[ intersection between Pit 2/3 road and Pit 5/6 road and <br />along the Pit 4 road. Main entrance gate at Routt County Road No. 27 was locked. DMG has been provided <br />with the combination. Cattle were present near Routt County Road No. 27, though not further south on the <br />Grassy Gap property. Gate was locked upon leaving the site <br />Roads : The access road to Pit 5 and 6 remains in good condition. Ditch along side Pit 5 access road has filled <br />with sediment and grassed in. Runoff flow through this ditch appears to still be functional. Pit 5 spoil spring <br />flow is low. A 18" diameter pothole, approximately 8 inches deep has opened up 15 feet north of [he pit 5 spoil <br />spring. Water is present in the bottom of the pothole but was not flowing. Access road to pit 1 was gullied and <br />accessible by foot. The access road to Pits 2/3 has developed gullies from runoff and spring water flow. This <br />road is accessible by foot as well. The majority of water from the native springs on access road 2/3 continues to <br />be directed off the roadway. Pit 4 access road remains in good condition the entire way to the pit. Some water <br />cutting across the road has occurred but road is still drivable. <br />Hydrologic Balance: Pond 5 was discharging. Pond 5 side slopes and embankment appear stable. No additional <br />slumping of the pond cut slope, or of the pond inlet was apparent. Pond 4 was holding a small pool of water <br />several feet below the outlet elevation. The lower (northwestern) portion of Pit 4 ditch has breached. Runoff <br />from this ditch short circuits Pond 4 and runs down pi[ 4 access road ditch instead. Repair of this breach would <br />direct additional water into Pond 4 in support of the post-mining land use. <br />Reve¢etation: Vegetation in the pit areas is in good condition. No livestock grazing has been conducted on the <br />mine site yet this growing season. Vegetation has recovered remarkably from previous 2 years drought <br />conditions. Vegetation in pits 5, 6, 2/3 and ]are dominated by smooth brome with wheatgrass species sprinkled <br />in. Slopes appear stable with little gullying observed. Two gullies were noted in Pit 1. These have formed <br />between contour furrows and are of short duration. These gullies have been noted in previous reports and do not <br />appear to be enlarging. A small patch of White[op was observed between pit 5 and 6. Occasional Canada thistle <br />and Hounds[ongue were noted in [he various reclaimed pits. However, [he overall mine site appears rather weed <br />free. Spot weed spraying could be beneficial to assure no further spread of noxious weed species. <br />Slides: No new slides were noted. The old slide to the west of pond 4 is healing and is almost hidden by <br />vegetation. <br />Wildlife: No wildlife other than songbirds and a Golden eagle on pit 4 were observed <br />
