The mine is located on Township 6N, Range <br />ti7W, Section 19 under Colorado mining permit M83-090. <br />Our pipeline is logted 1m a narrow strip of property which hasn't been mined, but <br />gravel mining pits are located on either side of our pipeline. (See attached sketch) <br />During high water conditions on May 2, 1999 river water filled the Western pit and <br />overFlowed into the EastF;m pit across the narrow strip of land containing our pipeline. <br />The subsequent erosion undermined our pipeline causing us to shut it down. <br />On May 5, 1999 SinGaiir examined the pipeline using a contract diving firm and <br />determined that it was sarfe to restart the pipeline, because the unsupported spans of <br />pipeline in the eroded area were not long enough to endanger the integrity of the <br />pipeline. Our wntention is that we have been damaged (inspection and repair costs) <br />by the gravel mining operation and that Hall-Irwin should provide an engineering <br />remedy that will prevent the situation from reoccurring. But Hall-Irwin's position is <br />that what occurred was la once in a life time act of god which would have occurred <br />regardless of the change in ground contour caused by their mining operation.
