<br />THIS PERMIT is .issued this 8th day of September 1978 by the Hived Land
<br />Reclamation Board, Department of Natural Resources, ~tata of Colorado.',
<br />W I T N E S S E T H
<br />WHEREAS, Martin Marietta Corporation desires to conduct o(n)o en mining
<br />operation, known as Martin Marietta Silica , for the purpose of extga,ctiag open
<br />mined sandstone aRd Quarry
<br />WHEREAS, onNovember 28 1977 > Martin Marietta Corporation "FILED" an appli-
<br />cation, a reclamation plan and map, and the required fee, as required by law; and
<br />WHEREAS, on September 8 , 19 78 , the Mined Land Reclamation Board approved
<br />Martin Marietta Corporation application and net bond; and
<br />WHEREAS, onseptember 8 , 19 78 , the Mined Land Reclamation Board accepted surety
<br />submitted by Martin Marietta Corporation and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />WHEREAS, the Hived Land Reclamation Board has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />Mined Land Reclamation Act sad all applicable local, state and
<br />Federal lays; and,
<br />2) the operation will vat adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected load, except where there
<br />is an agreement between the operator and the persons having ar.
<br />interest in the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements of C.R.S. 1973, 34-32-116,
<br />as amended (1976 Seas. Laws H.B. 1065); and
<br />'.THEREAS, for the purposes of issuing this permit, the operator has made
<br />a satisfactory shoving co the Board that he will employ during and after his
<br />opP.R mining operations procedures reasonably deslgned to miniaize
<br />as practicablE the aisruption from the mining operations and vi::
<br />provide for the rehabilitation of the afpfected land through the rehabilitation of
<br />cover, soil stability, vacer.resources, and other measures appropriate to the
<br />subsequent. beneficial use of such mined and reclaimed lands; and teat in
<br />the event of the failure of his proposed reclamation plan, he will take whatever
<br />measures which may be necessary in order to assure the suttees of reclamation of
<br />the lands affected by.his open mining operations,; and,
<br />WHEREAS, for the purposes of issuing this permit, a copy of the application
<br />approved by the !lined Land Reclamation Board of the State of Colorado la attached
<br />to this permit and thereby becomes a part of the terms hereof.

<br />NOW, THEREFORE, pursuant to the authority set forth in the Colorado :lined
<br />Land Reclamation Acc, Article 32 of Title 34, C.R.S. 1973, as amended, (1976
<br />Seas. Laws H.B. 1065)•the Mined Land Reclamation Board of the State of Colorado
<br />hereby issues a life of the mine permit co Martin Marietta Corporation to engage in
<br />open mining far thn purpose of extracting open
<br />mined sandstone „n the following parcel of ground, co wit:
<br />9.5 acres located in the NE '~ of the SW ~y Section 20, Township 3
<br />North, Range 70 West 6 P.M.
