III. COMMENTS -COMPLIANCE <br />Below are comments on the Inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Jim Kiger <br />represented the operator. <br />Siens and Markers <br />The mine ID signs were up at the appropriate locations and contained the correct information. <br />The permit boundary markers were present, as well. <br />Roads <br />The paved haul road was in very good condition. The guard rail was in place. The graveled east <br />road was also in good condition. The east gate was open. <br />Hydrology <br />The water level in Pond 1 was within 2 feet of the prunary discharge tube, although the gated <br />primary valve was closed. There was no standing water in Pond 2, the dugout pond. The <br />spillways of both ponds were functional. The embankment of Pond 1 was well vegetated and <br />appeazed to be stable. The vegetative cover on the outslope of Pond 2 was poor. However, the <br />riprap downdrain was functional. <br />Culverts at the site were cleaz and functional. The mine site collection and diversion ditches had <br />sufficient capacity. The straw bales and silt fence were functional at the raikoad SAE. <br />To soil <br />The operator recently seeded the west topsoil stockpile. The south-facing slope had lost much of <br />its vegetative cover. The operator may apply matting over that portion of the topsoil stockpile <br />azea. There were no erosional problems at the east and west topsoil stockpiles. <br />Facilities <br />Coal haul trucks were unloading coal and railcazs were being loaded during the inspection. The <br />stockpiled coal was of moderate size. No signs of offsite fugitive dust were observed during the <br />inspection. <br />There were :po problems observed at any of the facilities. The bench outside berm was <br />functioning well. There were no fuel leaks at the fuel facility. <br />Records <br />The records were in compliance, as recorded on the following records checklist <br />c:/word/terror/insp 1103 <br />
