Banta, <br />Division Director <br />As instructed, I called Brent Anderson today. I told him that serious <br />maintenance issues have been identified on-site, one of which could lead to <br />enforcement action. Specifically, the perimeter ditch at the Pit 4 area must <br />be maintained and/or repaired. Brent stated that ACZ had been contracted to <br />conduct a maintenance assessment of the site, and ACZ was to contact Brent <br />this week. Brent had not heard of their findings .yet, but he indicated that <br />he would contact ACZ immediately. Brent acknowledged that maintenance is <br />important, and he would contact us shortly with specific commitments and <br />schedules. He asked that we send our list of work items as soon as possible. <br />I told him that although we may pursue enforcement for such items as the <br />perimeter ditch, we would wait to hear from him regarding a specific <br />maintenance schedule. <br />I committed to the following: <br />l.) We will send both the May and June inspection reports immediately. <br />Specific maintenance items will be listed in the reports. I also <br />indicated that we would be more timely with our inspection mailings <br />in the future. <br />2.) We will send all legal notices, enforcement documents, inspection <br />reports, etc. to the designated legal agent (CT Corp.), with a copy <br />to Brent's firm. Brent mentioned that we ma.y not have been mailing <br />documents to the proper agents. We should be careful that this <br />detail is properly implemented in the event that our processes <br />become court issues. <br />DAB/yjb <br />6349E <br />
