III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Jce Dudash of the Colorado Division of Reclamation, Mining and <br />Safety. No one represented the operator during the inspection. <br />Roads <br />The Hubbard Creek road was passable. The access road across Hubbard Creek and leading to Pond 4 was also <br />passable, with only one spot that was muddy. The front gate was open. <br />Hvdrologv <br />The elevation of the standing water in Pond 4 was about 8 inches below discharge. The gated valve on the <br />primary discharge tube was in the closed position. Pond 4 was dry. Both pond embankments were stable and <br />spillways were functioning properly. <br />The collection ditch leading to Pond 4 was vegetated and had sufficient capacity. The black plastic culvert that <br />drains water from the upper reclaimed bench into the collection ditch was in place. The upland diversion ditch <br />and the road culvert at the reclaimed coal stockpile area west of Hubbard Creek were operational. The Hubbard <br />Creek culvert was clear. <br />Reclamation <br />The reclaimed slopes of the mine appeared to be stable. There was no evidence of slope instability or erosional <br />gullies and there was no ponded water on the reclaimed benches. However, there was a small seep at the base of <br />the second reclaimed lifr on the north side of the site. The vegetative cover on the backfilled slopes and benches <br />was good. <br />There was a steady flow of drops coming out of the north underdrain. There was no water observed coming out <br />of the other underdrains. <br />No problems were noted with the reclaimed road. <br />Siens and Markers <br />The mine [D sign and the records location sign were up on the gate. Surface disturbance markers were up <br />around the disturbed area. <br />c:/word/blueribbon/insp 1106 <br />
