III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. The operator was <br />represented by Jim Kiger. There had been a recent precipitation event at the site. The site was wet. <br />Roads <br />The paved main haul road was in very good condition. The guard rail was in place.. The east side <br />graveled entrance road was in good condition as well. The light use road along the tracks was passable. <br />Signs and Mazkers <br />Permit boundary marker signs were up around the site. The mine ID signs were up at the appropriate <br />locations. The operator has obtained and will soon put on new address labels on these signs, since <br />Delta County has recently changed all of the county addresses. <br />Tonsoil Stockniles <br />The west topsoil stockpile was well vegetated. The collection and diversion ditch berm had sufficient <br />capacity. The topsoil sign was up. The east topsoil stockpile had moderate to good vegetative cover. <br />The collection ditch and the diversion ditch were functional. The topsoil sign was up here as well. <br />Hydrology <br />The water level in the east pond was to within one foot of the primary tube invert. The gated valve was <br />closed. The pond inslopes and embankment were well vegetated and appeared to be stable. The west <br />dugout pond was dry. The outslope was recently revegetated but the grass is already coming up. The <br />spillway and riprap were functional. <br />Culverts were clear and ditches had sufficient capacity. The silt fence and straw bales at the railroad <br />small azea exemption were in place and functional. Along the west side of the site, the private <br />irrigation ditch appeared to have sufficient capacity, although no water was flowing, <br />Facilities <br />No problems were noted at the loadout office, shop, Loading facilities, material storage area, substation <br />and fue- facility. During the inspection, railcars were being loaded and one coal haul truck was being <br />unloaded. There were no problems with fugitive dust. <br />Records <br />The mine records were in compliance, as documented in the attached records checklist. <br />c:/word/terror/insp l 1 OS <br />
