• (Page 2) <br />MINE ID # OR PROSPECTING ID # M-86-033 <br />INSPECTION DATE 2-17-99 INSPECTOR'S INITIALS SSS <br />OBSERVATIONS <br />This was a roitine partial inspection and bond recalculation inspection, conducted at the Hess Pit. <br />The pit remains unchanged, for the most part, since the last inspection. Minimal backfilling of the west end of the Level <br />1 highwall has been done. Mining operatons, since the last inspection consist mainly of stockpile removal. No processing <br />tacilities are on-site at this time. <br />The operator is currently in litigation with the Southern Ute Indian Tribe over ownership of the rights to the gravel deposit. <br />This is the reason for the limited activity at this site in the past few years. The litigation process is anticipated to be <br />completed in the next year. <br />A few drums of hazardcus material remain on-site and are not in propoer spill containment structures. In the event of a <br />spill, the material would remain in the pit, due to current site grading. However, the adverse affects of the spill would not <br />be minimized. Therefore, as specified in the last inspection report, the operator must ensure all hazardous materials at this <br />operation are properly stored within an adequate spill containment structure. <br />The operator has begun to store some scrap metal and salvage machinery at the site. No additional materials of this type <br />should be brought on to this site. If this does occur, the reclamation cost estimate will need to be increased for proper <br />disposal of this material. <br />The reclamation cost estimate for this operation was recalculated and a copy is enclosed. Increases in reclamation costs, <br />since the reclamation cost estimate was last calculated, has caused the current financial warranty for this site to become <br />inadequate.
