V~ <br />RE: Access to t e Colony roject for Inspection Purposes <br />Roy Cox and I visited the Colony site Thursday, June 19th to examine the road <br />and mine bench construction. Construction activities seemed high, with blasting <br />frequent enough to make it impractical for us to closely inspect the construction <br />site. We were escorted to the experimental mine portal bench where we could <br />observe a portion of the bench and road site under construction. <br />Approximately an hour was required while their site personnel acquired the <br />appropriate access and camera permission for us to enter the site. I pointed <br />out that while we understood the various insurance requirements and confidentiality <br />concerns, we, nonetheless, required access by regulation and Iaw. They in <br />turn assured us that it was not their intent to deprive access, but only to <br />assure safe conduct, etc. <br />I suggested that we would contact Arco Coal Company's offices in order to <br />obtain the appropriate clearance for individual's commonly requiring access <br />to the site, including permission to carry cameras and appropriate field test <br />equipment. They referred me to Les L. Ludlam for such permission. <br />I recommend that we forward the appropriate notification and request for <br />permission for access to Les Ludlam. I believe we should outline the appropriate <br />regulation and law requirements, including a statement of our intent to respect <br />their confidentiality. We should, however, be stern about our expectation for <br />prompt and unrestricted access during normal working hours.
