COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />durng the inspection Comments also descnbe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />ReclamaUOn, Mining, and Safety (Division). This former mountaintop removal operation is <br />now reclaimed and has achieved a Phase I bond release far most areas Ground conditions <br />on this day were generally dry but small depressions on the reclaimed area held puddles of <br />water. Ron Thompson of Peak Protect Management accompanied me on the inspection <br />Roads <br />A large sediment trap has been constructed above the second culvert ascending the Jeff <br />Canyon haul road This culvert passes a significant amount of runoff from poorly vegetated <br />undisturbed areas and requires frequent maintenance. <br />Hvdroloaic Balance <br />All ponds were holding water slightly below the lowest discharge point Recent storms in the <br />region have resulted in numerous runoff events- Embankments at all ponds now have <br />significant perennial vegetation established. Spillways appeared in good condition and <br />passed storm runoff without incident.
