Said Flood Insurance Study, related maps, and <br />Floodplain Information Report including Plate 16 thru 18 thereof, shall <br />be and are hereby adopted and designated for use in the <br />enforcement and administration of these regulations. <br />(Source: Ordinance No. 4, 1985) <br />2. The Building Official shall interpret the exact locations of the <br />boundary of the flood-way, flood-fringe, and high hazard area and of <br />base flood elevations as provided in the study and maps referenced <br />above. Elevations determined from the profiles shall take precedence <br />over plate or maps. <br />{Source: Ordinance No. 4, 1985) <br />3. In interpreting the boundaries of the flood-ways flood-fringe, high <br />hazard areas and determining base flood elevation, the Building <br />Official shall obtain, review and reasonably utilize any base flood <br />elevation data and other data available from other federal sources or <br />sources officially approved by the Colorado Water Conservation <br />Ordinance No. 4, 1985) <br />Obstruction of Flumes, Creeks or Water Courses Prohibited; <br />It shall be unlawful to obstruct or interfere with the proper operation of <br />the Portland Flume, Cascade Flume and Catchment Basin, <br />appurtenant access easements, the channel of Skyrocket Creek, <br />Ganyon Greek, Oak Creek, and Bridal Veil Creek and other water <br />courses or flood control facilities and appurtenances by placing or <br />allowing any obstruction, including, but not limited to bridges, <br />cantilevered structures, culverts, rocks, trash or other; 'thin <br />such facilities or otherwise. <br />2. All residences or of er w rugs designed or used for occupancy <br />erected, or liquefied petroleum gas tanks installed, after the effective <br />date of ordinance No. 2 (Series 1983) shall be set back a minimum of <br />ten feet (10') on either side from the outside walls of the Portland or <br />Cascade Flume. <br />K. Enforcement: <br />It shall be unlawful for any person to violate any of the provisions of <br />this section. Any person convicted of such a violation may be <br />punished by a fine of up to $300, or a jail sentence of up to 90 days or <br />by both such fine and imprisonment; provided, however, no person <br />under the age of 18 years shall be subject to any term of <br />52 <br />
