III. COMMENTS -COMPLIANCE <br />Colowyo C-1981-019 <br />22 August 2007 <br />Pg 1/7 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br />The inspection was conducted on 22, 23 and 24 August 2007. Tony Tennyson of CCC <br />accompanied me on the inspection. Tay Tono~i and I discussed some of the <br />permitting actions that are currently outstanding at the Colowyo Mine and ones that <br />are in the planning stages. The mine was actively mining coal and hauling coal to <br />the loadout at the time of the inspection. The weather was warm and raining on 22 <br />August 2007 and the ground was wet (obviously) and warm and overcast on 23 and <br />24 August 2007 and the ground was dry. <br />A copy of Technical Revision 67 and a copy of a letter requesting a 60-day extension <br />for the submittal of a revision for Stipulation 5 were hand-delivered at the time of the <br />inspection. <br />Signs and Markers: -All of the necessary signs were in place as required at the time <br />of the inspection. Mine ID signs were in place at the main entrance and at all of the <br />ponds along Colorado Highway 13 as required. All topsoil stockpiles had signs. With <br />the construction of the Section 28 Pond about to begin, Colowyo needs to put a <br />mine identification sign at the access point (by the Sturgeon house) along Colorado <br />Highway 13. <br />Roads: -The mine access road and haul road to the Gossard Loadout is a paved <br />road. The road was well maintained and in good condition. <br />-The light-use road in Taylor Draw to the West Pit Pond and East Taylor Pond was <br />stable and well maintained at the time of the inspection. There were some ruts but <br />overall the road was in good condition. <br />-The haul roads in the East and West pit areas were all well maintained and stable at <br />the time of the inspection. The roads were dry but there was not a problem with <br />fugitive dust at the time of the inspection. The operator was constantly watering the <br />roads to try to keep the dust down. No erosional problems were noted on these <br />roads. <br />-The light-use roads around the Gossard Loadout and to the rail loop were well <br />maintained and in good condition, <br />-The road for the construction of the West Taylor Pond was stable and well <br />maintained at the time of the inspection. This road will be used as an access road for <br />the pond upon the pond's completion. <br />-The Sturgeon road (which is the access road for the Section 21 and Section 28 <br />Ponds) has been hard-bladed and the Missouri crossings have been constructed. <br />The operator is planning on placing the gravel surface on the road after the <br />construction of the Section 28 Pond is complete. <br />
