SULLNAN <br />SUBJECT: HARD ROCK PAVING & RED[-MIX, ING - E-I~GY 291 P1T, MINING PERMIT X M-77-195 <br />DATE: 02/22/99 <br />CC: JAMES STEVINS, CDMG; DMSION 2 OFFICE <br />On February 18, 1999, our office received a copy of the Febmary 3, 1999, inspection report by the <br />Division of Minerals and Geology. The report (attached) indicates probable water rights issues, <br />including "an active and significant seep of water' present ac least since September of last yeaz, and <br />resulting in a "large area of ponded water" on the pit Eloor. We have not identified a permit or <br />Substitute Water Supply Plan for the "pond," nor was it identified in the mining or reclamation plans <br />on file with DMG. <br />Please inspect the site and review any infottnation you may have to determute <br />• the estimated ground water exposed in the pond, confimvng the source is ground water and/or <br />identifying any other/additional water sources, <br />• any water source(s) for their operations and the legality of such use, <br />• identify any decrees, permits, or SSP's you maybe aware of for the operation, and <br />• anything else you believe would be useful in evaluating compliance. <br />You may want to contact Jim Stevens, the CDMG inspector, at (303) 866-3567, for additional <br />location and operations information or co accompany you. If found in noncompliance, we will use <br />the information gathered at your and CDMG's inspections to drab a letter ordering them to take <br />actions to achieve compliance with statute.
