III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Carbon Junction Mine for the month of November, 1 996. <br />Frank Kugel, from the Dam Safety, Water Resources Office in Durango, CO, was present during <br />the inspection to inspect the 100 year diversion structure that is to be built in the near future at <br />the mine site. <br />Records were inspected and the results are presented on page 5 of this report. <br />The site is stable with no visible sign of any significant erosion. Pond 2 had a trace amount of <br />water in it from snow melt. Pond 1 was dry. Both ponds are stable and capable of functioning <br />as designed. All ditches and culverts were inspected and found to be in satisfactory condition. <br />Construction of the 100 year diversion structure will commence as soon as it is approved by the <br />Division. Frank Kugel stated that the impoundment should pose no problem and will not need to <br />be inspected by Dam Safety. He will send a letter to the Division this week. <br />
