IV. ENFORCEMENT ACTIONS <br />Elk Creek C-1981-022 <br />15 March 2006 <br />The following identifies enforcement actions taken during this inspection, the required abatement and <br />date of abatement for the violation, previous violations still requiring abatement and the termination of <br />violations cited during previous inspections. <br />The Division issued Notice of Violation CV-2006-001 on this inspection. This violation was issued for <br />the drilling of a gob vent borehole at the Hubbard Creek Fan pad without first obtaining approval from <br />the Division. This borehole was not included in TR-51, which approved the drilling of and injection well <br />from the D-seam to the B-seam for mine water. Neither was this well included in TR-53, which <br />approved the drilling of 15 gob vent boreholes. <br />The drilling of the GVB is in violation of Rules 2.08.4(3); 2.05.3(3)(a) and 4.04 and applies to permit <br />section 2.05 (page 2.05-31a (E)) and Drawing 3.02-M1. <br />The abatement for this violation is as follows: <br />1. Submit a Minor Revision to the Division adding the GVB to the appropriate permit text and <br />maps. <br />2. Submit a completion log for the GVB. <br />3. Submit the appropriate bond for the GVB. <br />4. Have the MR approved. <br />The abatement date for steps 1-3 of the violation is 3 February 2006. The abatement date for step 4 <br />of the violation is 3 March 2006. <br />On 10 March 2006 the Division received responses to the second round of adequacy comments for <br />Minor Revision 76, which addresses the abatement for the violation. The comments adequately <br />address all of the Division's comments. The Division will propose a decision to approve MR-76 on 21 <br />March 2006. Following the completion of the 10-day comment period, if no comments are received for <br />MR-76, the Division will terminate NOV CV-2006-001. <br />
