This letter ~~+++*~ a,;~~s the poi~s agreed to by Colorado Parks and Transit Mix of Pueblo
during our inspection of your land recently acquired from Valco, known as the Chain of
Lakes, related to the finalization of the reclamation as required by the Division of
Minerals ~ Geology. The meeting was conducted at 9A0 AM an 7uly 13, 2004 on site
and attefnded by yourself and Mike Dowd of Colorado Parks, Berhan Keffrlew of the
DMG,.Mark Heffner, Transit's outside reclamation consultant, and Bill Pope, Pete
Melcllerj Mark IUune and myself, all of Transit.
Transit Mix of Pueblo is requesting full release of its reclamation responsibilities from
the DMG and once the following items have either been accomplished or have a plan to
acconnplish them; Colorado Parks will assist Transit is obtaining this release.
Item.1. *- Establish all stttvey points to Colorado State Parks satisfaction.
Itefir 2= * ~ Eradicate all Russian Olives and Tamarisks on the requested release land,
except for those plants located in the CDOT drainage easemem area just
north of Highway 96 near the west side of the release area. This land was
~ ~~ not disturbed by the mining process and presently incorporates wetlands.
Removal would harm these wetlands as well as destroy a very phasing
- visual area. fltrihermore, these species are bound by the highway as well
as the drainage ditch which will limit their proliferaT'ton.
Item' 3 * A Modify the berm on the north side of the CDOT d*A"''woe ditch which is
located just north of Highway 96 near the west side of the release area.
• - Transit will seed the berm after modif cation and at the best titae w do so.
Item 4 ~ Remove one power pole at the first Litvak gate and replace it with another
post for the gate.

Item 5 No additional reclamation will be necessary on the road immediately to
the north of the southern most lake az the west end of the release azea.
Item ~6 ~~' A Groom the eastern most top soil pile end seed, when appropriate. The
