ORIGINAL - POBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn_t977-574 <br />INSPECTION DATE: 1./t3/Od INSPECTOROS INITIALS: ~~ <br />OBSERVATIONS <br />The Division conducted a joint inspection of the site at the request of the <br />State Parks department. The site used to be a large 112 sand and gravel <br />operation located approximately 2 miles west of Pueblo Colorado, along <br />highway 96.The main purpose of the inspection was to determine how much <br />work Transit Mix had to do in the land that is now owned by State parks, <br />which is still in the DMG approved permit. Approximately 220acres presently <br />with in permit # M-1977-573 is being proposed to be released before it <br />meets the approved recalamtion plan. State Parks acquired the property and <br />plans to convert it into some kind of recreation area; because of it is <br />location along the Arkansas River. The main purpose of the inspection was <br />to take inventory of what additional work State Parks wants Transit Mix, to <br />conduct in the proposed area prior to Transit Mix, requesting a partial <br />release. <br />The Division is going to deny the release request and Transit Mix of Pueblo <br />will appeal the Division's decision and the matter is expected to be <br />brought, before the Mined Land Reclamation Board In September, assuming all <br />the agreed upon work is completed on time. The entire area to be released <br />was walked and inspected and inventory of additional reclamation work to be <br />conducted by Transit Mix was noted. Both parties were notified that until a <br />signed agreement between Transit Mix and State Parks is submitted to DMG, <br />the partial release request couldn't be submitted. On 7/22/04 a signed <br />faxed copy by both parties was submitted. The agreement, with the exception <br />of one item, which still needs to be resolved between the parties appeared <br />to be what was noted during the inspection.
