Box 105 Executive Direcior
Florence, CO 81226 Michael B.Long
Division Drrecror
RE: Corrective Action, Swallow Perlite Mine, Permit No. M-77-319
Dear Ms. Steiner:
I inspected the referenced mine site in September, 1996. 1 noted a problem in my inspection report and
asked that you respond by December 17, 1996.
The problem I observed was no activity at the site for more than two years. The corrective action I
proposed was "the operator must re-activate mining activities or apply for temporary cessation or initiate
reclamation". If the choice was to initiate reclamation you were to submit a letter to the Division
outlining an approximate timetable for each proposed operation. However, if you elect to apply for
temporary cessation you must do so pursuant to the requirements of Rule 1.13. If you decide to re-
activate the site you should have sent a letter to the Division indicating your intent.
As of today, January 16, 1997, I have not yet received any correspondence from you. You need to let
the Division know what you plan to do. And you should do so by February 14, 1997. Otherwise, the
problem could become a possible violation.
If you have any questions, give me a call.
Sincerely,
James Dillie
Environmental Protection Specialist
M\oss\lung\Sieircr.ID I
