<br />Ill. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Arness McGriffen Mine was conducted by DMG staff from <br />the Durango Office, 701 Camino Del Rio, Room 125, Durango, CO 81301, phone (970) <br />247-5469. The permit for the Arness McGriffen Mine was revoked over 5 years ago. <br />Financial warranty was forfeited and utilized for final reclamation. No activities were <br />observed, no personnel encountered during the time of this inspection. <br />The mine access road remains open to provide access to public lands, located north of <br />the permit area. Public access is controlled by locked cable gate closure, recently <br />constructed across the road. A sign on the gate indicates that public lands are state <br />lands and that the Colorado Division of Wildlife has restricted public access to the area <br />from mid November through mid March. Evidence of erosion was observed in side <br />drainage ditches and on the driving surface of the mine access road. <br />Portions of the reclaimed area have been adversely impacted by off-road traffic. <br />Domestic debris has been illegally dumped by unknown individuals. Debris includes <br />cardboard boxes, plywood, wafer board, particle board, lumber, beverage containers, <br />lubricant containers, computer and various electronic components, phone books, <br />Christmas wreath, and empty shell casings from small arms ammunition. The <br />discarded debris exhibited numerous bullet holes. Mattress and box springs, tire, and <br />appliances had been dumped off the steep bench slope into the Coal Gulch permit area. <br />Weeds, including several varieties of thistle were observed along the access road and <br />within reclaimed areas. <br />
