III. COMMENTS - COMPLLANCE
Below aze comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado Division of Reclamation, Mining and
Safety. No one represented the operator during the field inspection.
Sins and Markers
The post that holds the mine ID sign is still on the ground and should be put back up. Surface disturbance
markers defined the disturbance area.
Roads
The paved haul road was passable and in good condition. The bridge was also passable.
Facilities
The front gate to the site was closed and locked. The "no trespassing" sign was up on the gate. There is nothing
new to report concerning the mine office building.
Hydroloev
There was some standing water in the sediment pond, at a level about two feet below the primary discharge
pipe. The gated valve was in the closed position. The riprap was present in the emergency spillway. The
sediment pond embankment appeared to be stable. The collection ditch leading into the sediment pond was well
vegetated and had sufficient capacity.
There was the usual orange-colored discharge of about 20 gpm coming out of the spring water treatment pond.
This discharge water has been shown, in the past, to be in compliance. The water level in the spring water
treatment pond was to within 6 inches of the horizontal pipe.
The temperature of the water coming from the east spring was about 102 degrees Fahrenheit, measured at a
point that was 10 feet below its origin in the hillside. There were no problems with wells AA-1 and AA-3.
Noxious Weeds
There is tamarisk growing in three places: along the west side fence, along the water's edge in the spring water
treatment pond and in the area of the east spring. This is in spite of relatively recent noxious weed removal
efforts.
Reclamation
The reclaimed portal road and fan portal area were stable and well vegetated. However, the west portal azea
continues to show instability. However, there was no odor of smoldering coal in the backfilled west portal area.
c aword/bear3linsp 1106
