The problems fall under the topics of "signs and markers," "topsoil," and "revegetation." The problems
described in that report list specific actions to be taken to correct them, and deadline dates by which this office is to
receive evidence of such correction. To-date this office has not received any response from you for any of the
problem corrections.
You should be aware that by not addressing a problem at a mine site in a timely or adequate manner, the correction
to the problem may increase in scope or cost. Also, by not submitting a required response to a documented
problem, the severity may increase to a point where additional bond or enforcement action becomes necessary. The
problems noted at your pit are easily remedied, and it is hoped that you do so soon.
In the interest of bringing your attention to the problem items again, I have attached a copy of that 7/3/02 inspection
report to this letter. Please review it, take whatever actions are necessary at the site, and submit to me a written
statement describing the corrective actions carved out.
You must do these things within the next 30 days, including submitting your response to me, to avoid possible
enforcement action. I look forward to your response. Please contact me with any questions, and submit your
responses directly to me, at the Division's Durango field office: 701 Camino del Rio, Room 125, Durango, CO
81301; tele 970/247-5193 or fax 970/247-5104.
Sincere//ly, r~))~
~db C/S-wwrr~,.
Bob Oswald
Environmental Protection Specialist
CERTIFICATE OF SERVICE
I, Bob Oswald, certify that I mailed this letter to the addressee, by placing it in the first class mail of the US Postal
Service, on the date shown at the top of the letter.
$~~ ~~(signed)
encl: 7/3/02 inspection report
(a:\spor pb late/tno)
