Normally the Division does not conduct a <br />pre-operational inspection of 110 sites. However, during an SO inspection of the old Lopez <br />quarry located East of the current proposed site, the Division had noticed disturbance <br />associated with mining in the current proposed area. Operator's consultant was notified of <br />the pending inapection, but was unable to attend. <br />Mr. VALDEZ AND THE Division had been working on trying to get a workable language as post <br />mining land use for another site in Las Animas County, which was permitted by the county <br />for dual use. Mr. Valdez wanted to accompany the Division to see the area and Mr. Bobby <br />Hill's possible Illegal operation, located south of the Lopez Quarry. <br />As noted above the area appeared to have been freshly graded, from what was noted a month <br />ago. A large stockpile of processed material was noted along the West side. <br />After returning to the office, the Division contacted Mr Ron Thompson, the consultant and <br />permitting contact. He stated that the material was used on Mr. Lopez's property as road <br />base and nothing was sold. Now that he has a commercial account and wants to sell the <br />aggregate, the permit application was submitted. That being the case and sine the 100 <br />permit application is submitted, and is under review, the Division will accept the <br />explanation. <br />Mr. Valdez stated that the County has not received an application for a conditional use <br />permit On 6/26/07, the Division received a letter from Mr. Robert Valdez stating that <br />the area proposed in the application for a 110 sand and gravel site is not compatible with <br />the Las Animas County Land Use Planning Contacted r. Thompson by Phone on 6/29/07, he <br />said he has a meeting with Mr. Valdez on Monday 7/2/07 and after the meeting even if the <br />county still wants is to be Rural Residential as post mining land use, they might amend <br />the mining plan to grade it to the required slope for such use and amend their mining and <br />reclamation plan. <br />I & E Contact Address <br />NAME: MR.
