Compliance with Colorado Surface Coal Mining Reclamation Act <br />CRS 1973, as amended 34-33-101, et. sue., <br />and the <br />Rules and Re ulations Issued Pursuant to the Act <br />This includes a listing of the particular provisions of the regulatory program which were <br />examined during the course of this inspection, and identifies enforcement actions taken <br />during the inspection for failure to comply with the Rules and Regulations, the Act and <br />the permit. <br />4.02 Signs and Markers <br />Mine permit and identification signs, and topsoil markers are in good repair and in <br />compliance. The entire perimeter of the mine permit area is Fenced. There is no blasting <br />occurring at the site. <br />4.03 Roads <br />All roads (including the access road across BLM land) are in good condition and in compliance. <br />All culverts were clear and serviceable. Riprap has been placed at the outlets of <br />conduits to reduce erosion. <br />4.05.5 Sedimentation Ponds <br />The operator has stabilized the outslope embankment per procedure outlined in Robert Liddle's <br />March 25, 1981, inspection report. The stability of the embankment should not pose a <br />problem. Pond A needs to be brought into compliance as soon as Division review and <br />approval is granted. <br />4.05.13 Surface Water Monitorin <br />The embankment in Mann Draw in which the parshall flume is in place has been regraded. There <br />is still a concern that Mann Draw ruhoff may pond behind the embankment. This will be <br />evaluated in inspections and in the permanent program application. <br />4.06 Topsoil <br />The buffer zone around the horseshoe dump has been cleaned of all debris. It appears that <br />activity has taken place on topsoil stockpile B. This small area of disturbance will need <br />to be seeded this spring. <br />4.09 Disposal of Excess Spoil ~ <br />The horseshoe dump continues to grow in size. A potential concern is that material on <br />the outslopes appears to be deposited at the angle of repose, posing a potential stability <br />problem. This will be evaluated in terms of the existing permit and in the context of <br />the new permit application. <br />4.28 Support Facilities Not Located At Or Near The Mine Site <br />The Northgate loadout facility was inspected and a Iarge amount of unpermited disturbance <br />has occurred. The operator has stripped and stockpiled topsoil at the site. No sediment <br />control facilities are in place. Large equipment has driven through marshy areas causing <br />significant disturbance. In the February 26, 1981, inspection the operator told this <br />inspector that no operations were planned for the loadout facility. In conversations <br />with Jay Stewart of Flatiron Company late in 1980, it was stressed that if the loadout <br />was to be needed for operations in mid 1981, the operator should seek an interim program <br />approval for the site. The operator elected to incorporate the loadout in the permanent <br />
