(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2005-012 <br />INSPECTION DATE: 4/26/05 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS GRM <br />This inspection was conducted as part of the normal program established by the Colorado Division of Minerals and <br />Geology for new applications. The Gray Pit No.2 was originally submitted back in 2003. However, due to a legal <br />issue concerning the original access from the east to the site the application was withdrawn. The applicant has since <br />then, established a new access route from the west and resubmitted the application. The original application was <br />close to final approval prior to the legal issue surfacing. Therefore, this inspection is more focused on the west <br />access point than most of the normal issues in apre-operational inspection. <br />The required Public Notice was observed at the proposed entrance to the site as required by Rule 1.6.2(b). <br />The new proposed road comes off Miguel Road from property owned by the applicant. The current road is gravel <br />- -for the first -1000 feet before it reaches a gate on an east /west line. From this;point it turns into atwo-track road or .. <br />trail-further up the ridge. The fact that the road is not preexisting credtes a problem within the application ~:? =- <br />submittal. It is'Division policy that if roads are constructed or have major irirprovements upon them, they must be: ' ~ : ~ <br />.included in the•permitboundaries. The applicant will have to submit:an amendment to the application that includes - <br />the road from the noted Bate to the permit boundarv. The.amendment_need onlyadd,in the additional acreag@ and a, : _ <br />general description of width and type of road to be constructed. If.the road is to remain afterwards for•other: , -.. <br />purposes please state so. That way the additional acreage does not impact the overall'reclamationbood. ~ - <br />Please note that any utilities, structures or easements must be noted and agreements with those entities must be <br />provided as well. Unfortunately, this also will require a new Public Notice Period and notification of adjacent <br />landowners.
