III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of, Reclamation, Mining, <br />and Safety (Division). Oblique aerial photographs were taken on September, 25, 2007 and reviewed <br />in the office by Jason Musick of the Division on September, 28, 2007. Photos taken are provided at <br />the end of the report. No problems were identified in the photographs. <br />Hydraulic Balance <br />Neither cell of the sediment pond exhibited evidence of holding water. The sediment pond inslopes <br />showed no signs of instability. <br />Backflll and grading <br />Both portal 1 area and portal 2 areas appeared to show no signs of instability. <br />Revegetation <br />The vegetation throughout the mine area appeared to be well-covered and dry. These conditions <br />were reflected throughout the area both on and off of the mine area. <br />There appears to be activity occurring to the north of the topsoil pile entering the mine area. Although, <br />nothing identified through the aerial photographs warrants an immediate on-the-ground inspection. <br />
