<br />This was a partial inspection conducted on Monday, July 23, by Jim Burnell and <br />Sandy Brown of CDMG, accompanied by Tom Anderson and Mark Milner of <br />Oxbow Mining, Inc. The weather was hot and dry. The site was active. <br />The inspection concentrated on a visit to the Elk Creek facilities area where <br />development of the new Elk Creek mine is proceeding. <br />The new pond was dry. All the features of the pond were present and in good <br />condition. The as-built for the pond has been requested. <br />The decline tubes were in place and nearly completed. The bottom of the tubes <br />will be filled with several feet of gravel and then with several more feet of <br />compactable earth to make a roadbed. OMI personnel discussed the need for an <br />additional vertical shaft in order to complete their air circulation system. This <br />shaft was not in the original plan, but the proposed flexible tube, hanging from <br />the roof of the declines, was rejected by MSHA as a means of returning air from <br />the mine. The location and the nature of the shaft was discussed and CDMG will <br />be ready to review the proposal when it comes in. <br />The shaft site, at the upper end of the construction site, is filled as far as it will be. <br />There is still four feet of metal superstructure above the fill. The next step will be <br />to excavate material from the bottom of those shafts to the coal seam. <br />Elk Creek was flowing at probably 200 gpm. Silt fence was in place around the <br />creek to keep additional sediment from entering the creek. <br />The topsoil pile appeared stable. Vegetation had emerged on the pile. <br />Approximately 75% more topsoil was salvaged than was originally estimated. The <br />ultimate destination of that extra topsoil probably won't be determined until the <br />time comes to distribute it. <br />The pond at the main facilities area contained a good bit of sediment. <br />The portion of the minesite up Hubbard Creek was in good condition. Vegetation <br />there was dry and brown for the season and there are some weeds making inroads <br />in the area. The road was in good condition and the signage was correct and in <br />place. <br />
