III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. This coal operation has ceased coal removal and is actively reclaiming the <br />disturbed area Ground conditions were snow-covered and somewhat muddy but all areas <br />were accessible. <br />Hvdrolpoic Balance <br />The outlet channel of the culvert diverting flow under the permanent road to the east <br />downdrain on Fill 8 should be better defined and/or riprapped to ensure flows enter the <br />downdrain as designed. Pond 9 was frozen and snow-covered. Ponds 6A and 7A were <br />found dry. None of the ponds visited were found discharging. The inlet above Pond 6A may <br />need to be better defined to prevent excessive erosion in this area. <br />Backfillinp and Grading <br />The majority of coal that was at the coal loadout last month has been hauled back to the <br />disturbed area and deposited in a shallow depression in the pit area northeast of Fill 7. The <br />coal was being covered with three-four feet of spoil using a D-8 dozer. The final <br />configuration will be a small knoll with surface runoff draining around each side of the knoll. <br />
