Page 2) <br />MINE ID # OR PROSPECTING ID #: ti+-9nnd-0as <br />INSPECTION DATE: Iona tn, 9nnd INSPECTOR=S INITIALS: A IW <br />OBSERVATIONS <br />This inspection was conducted as the result of a complaint received by the Division on May 26th, 2004. The <br />complaint alleged that mining was occurring on the Elk Horn Ranch and so far as the complainant knew, there <br />was not a mining or county special use permit for the activity. The location of the disturbance is approximately <br />2 miles northeast of South Fork, Colorado and adjacent to the Rio Grande River in Section 29, Township 40 N, <br />Range 2E of the NMPM in Rio Grande County, Colorado. <br />The site is located on the Rio Grande flood plain and is approximately 100-200 feet from the river. It is clear from <br />observations of the site that gravel mining has occurred. There is a significant excavation and several stockpiles <br />of un-processed and processed material on the site. The excavation is approximately 1-2 acres in size and <br />there is exposed groundwater in the bottom of the pit. It is clear that a significant amount of the processed <br />material has been hauled away from the processed stockpile. The majority of this material was apparently <br />used to construct roads in a 3Sacre development approximately 1 mile north of the gravel pit. The rest of the <br />material is being used to develop several lots adjacent to and west of the pit along the river. The total <br />disturbance is 5 acres or less including a topsoil stockpile and a newly constructed access road. <br />It is the opinion of the Division that this may constitute mining without a permit and therefore it is being cited as <br />a possible violation on page three of this report. A reason to believe that a violation exists letter was sent to the <br />landowner and the contractor. The landowner's name is Tom Smith and his representative is Tim Hiser of Salida. <br />The contract miner's name is Lowry Construction of Salida.
