111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DMG. Henry Barbe represented the <br />operator. The ground was dry. With the operator's consent, this report was issued from the Denver <br />office of CDMG. <br />Hydrologic Balance <br />Pond MB-4 was in good shape. The sediment trap has recently been cleaned out. <br />In connection with an update of the North Fork CHIA (for PR-10), mine discharge locations and <br />irrigation headgates were identified along the segment of the North Fork of the Gunnison River from <br />the West Elk Mine to Paonia. <br />Processing Waste <br />The faces of the Refuse Pile Expansion pile and the Lower Refuse Pile showed no evidence of structural <br />instability. Survey markers were in place on the faces of both piles. The top of the Lower Pile is being <br />used for equipment storage, as approved. <br />To soil <br />Stockpiles NSSA t and NSSA 2 were protected by a good cover of grass and had topsoil markers in <br />place. <br />
