The Division was
unsuccessful in contacting the operator by telephone to schedule the inspection. The
operator is r.=_quired to file a Notice of Temporary Cessation pursuant to Rule 1.13 of the
Hard Rock/Metal Mining Rules and Regulations if the operation will be inactive for more than
180 days.
The mine yard includes the shaft which has been secured with a sheet metal cover, the hoist
house, and a steel head frame. East of the mine yard is a historic mine shaft which served
as a waste rock dump area. In the Division's May 24, 1997 inspection report, the operator
was reminded that any further disposal of waste rock on the dump would be possible violation.
The operator is further reminded that this is still the Division's position. The Division
will evaluate the dump size in the future to ensure the disposal activity does not exceed the
maximum allowance.
The portal area of the Phil Sheridan Tunnel was inspected. A small pool of water just outby
the portal flcws approximately 50 feet through a grassy ditch, toward a dilapidated shack,
and seeps into the subsurface. There is no discharge into the dry gulch near the tunnel.
This gulch is tributary to Spruce Gulch. Because it is possible that the discharge may occur
during wet seasons into Spruce Gulch, the operator is again advised to obtain a discharge
permit for the Phil Sheridan Tunnel,
cc: Carl Mount - DMG
Davids Akers
Colorado Dept.
