III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on March 5, 2002. There were no problems observed during the <br />overflight. The aerial images were received on March 15, 2002 and reviewed on March 18, 2002. <br />There was scattered snow on the mine site, more at the higher elevations. The methane de-gas <br />sites and associated light use roads were covered in snow. <br />Main Mine site <br />A considerable amount of coal was stockpiled on the portal bench and the coal stockpile bench. <br />No problems with fugitive dust were observed, although Old State Highway 133 is showing <br />signs of black staining. <br />The paved main haul road was in good condition, as were the gob pile haul road and the access <br />road leading up to the water tank bench. <br />Cut and fill slopes appeared to be stable, although some of the higher elevation cut and fill slopes <br />were snow covered. <br />The south-facing portion of the main topsoil pile was clear of snow and no erosional gullys were <br />observed. The north-facing portion of the stackpile was snow covered. <br />Pond B was dry. The pond inslopes and outslopes appeared to be stable. <br />There were no problems observed at any of the f ,;ilities. <br />Train Loadout <br />The operator has begun construction work on the unit train Loadout and associated trackage. The <br />contractor is performing cut and fill operations for the tracks on the east end of the project area <br />and moving westward. The material storage area south of Old State Highway 133 is being <br />constructed as well. Straw bales and silt fence have been installed for sediment control. The <br />foundation for the transfer tower north of Old State Highway 133 is also under construction. <br />There were no appazent problems with sediment control. <br />c: \ms97\bowie2\insp0302 <br />
