III. Comments -Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />On May 12 and 14 a partial inspection was conducted at the Apex mine. This <br />inspection concentrated on the state of the reclamation. The weather was clear <br />and warm. All snow has melted around the facilities area, but water was flowing <br />in the ephemeral drainage above the former location of the office trailer. <br />The cutup storage bins that were sold to a Durango Company during the mine <br />auction are still stored on the county right-of-way. Mine has contacted Routt <br />County, and they will condemn the bins and remove them. <br />Erosion mat has been placed at the small area exemption. Water running down <br />the ephemeral drainage had loosened portions of the mat and caused it to creep <br />down the hill slope. The mat must be reattached to the drainage and properly <br />anchored (photos were taken). A small area above the mat (north side) will need <br />seeding and mulching. A larger area south and adjacent, will require mulching. <br />This area comes down to the old portal access road. <br />The drainage swale on the county road will require redug. The county has not <br />conducted spring maintenance as of yet; they usually do the maintenance but this <br />will need immediate maintenance by the mine before this structure looses its <br />design capacity. Also the county road ditch below the SAE will need cleaning. <br />Some seed is sprouting on the reclaim where the facilities once were. There <br />were 6 imported topsoil piles in this area that still need spreading. <br />The pond and embankment were functioning. There was a small puddle left from <br />the snowmelt and runoff. The residence area still has material that will be <br />removed. Two prelaw mine cars, a propane tank, a portion of metal bin and some <br />trash remain. <br />The roads to the portal must be ripped, blocked, mulched and seeded. <br />1 <br />
