Enforcement <br />action forthcoming. <br />OBSERVATIONS OF Tu~1POIZLANCE: <br />1. Very little topsoil has been salvaged for rrse in reclamation. Such salvaye is required <br />by the permit and the Rules and Regulations. Only a few hundred yards of topsoil are on the <br />site. This topsoil has not been stabilized by a perennial grass cover crep as required in <br />the permit, and is evidently being used for fines content in the product. Without topsoil, <br />there is serious question that reclamation can occur successfully. <br />2. Annual report and 5350 fee for 1981 has not been received by the Division. <br />3. Bond amount of $5,800 does not seem sufficient for this disturbance. <br />4. It is difficult to tell if the pzoper sequence of mining stages is being followed. <br />RECA~N~aTTONS <br />1. All future available topsoil will be salvaged for use in providing at least 5" of top- <br />soil for use in reclamation of future stages. This to~isoil will not be used as fines content <br />in the product. <br />2. The operator will submit a plan for pro vidiny sufficient topsoil for at least 6" of <br />topsoil yet to be disturbed. It should be mentioncc7 that this wastaye of topsoil is a <br />violation of this permit and could result in a civil penalty from the Mined Land Reclamation <br />Board. However, if an adequate plan for replacement of this topsoil can be approved by our <br />Division, it need not be taken to the Board for action. <br />3. Annual reports and fees should be brought up to date. <br />4. Bond amount will be reevaluated by the Division for possible upl:~ard revision.
