III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the operator <br />during the field inspection. The mine locations at the higher elevations were covered in snow. There was no <br />activity at any of the mine locations. <br />East Mine <br />The gate at the East Mine entrance was closed and locked. The mine [D sign was up at the entrance. The paved <br />haul road leading up to the crusher/screener bench was snow-covered in sections but was passable. The access <br />road and Tight use road leading to the higher benches were covered in snow but were passable as well. <br />The highwall at the portal bench appeared to be stable. The portal bench was covered in snow. The other <br />benches were also covered in snow. The straw bales were around the drop inlet and in the back ditch on the <br />crusher/screener bench. There were no signs of slope instability with any of the various bench cut and fill slopes. <br />There have not been any recent additions to the West Ridge waste pile. The West Ridge waste pile and the oid <br />waste pile were covered in snow but did not show any obvious signs of slope or erosional instability. Surface <br />disturbance markers were up around the site. <br />There was only a little snow in each of the four bin wall sediment ponds. The bin walls were stable and <br />discharge structures were operational. The lowest bin wall pond primary discharge pipe valve was closed and <br />the other three bin wall pond valves were open, as designed. <br />Run-of--Mine (ROM) Stockpile <br />This entire site was covered in about 6 to 8 inches of snow. The haul road was not graded but was passable. The <br />mine ID sign and surface disturbance markers were present. The sediment pond only had snow in it. The pond <br />embankment appeared to be stable and spillways were operational. <br />Unit Train Loadout <br />There was only a little snow at the train loadout. The west end collection ditch and drop half-culvert had <br />sufficient capacity. The ditches, culverts, berms and straw bales associated with the central upgradient clean <br />water diversion were all in place and were functional. There was no standing water in the loadout sediment <br />pond. The bin wall was stable and spillways were operational. The upland diversion ditches and culverts <br />associated with the sediment pond were functional. There were no problems with any of the loading facilities. <br />West Mine <br />The entire West Mine reclaimed site was snow covered. There were no obvious signs of slope instability or <br />erosional gullying. The two sediment ponds were snow covered as well. <br />Well Field <br />The entire site was covered in about one foot of snow. The light use road was snow covered and not graded, but <br />it was passable. The mine ID sign was up at the entrance.
